Who you are dealing with

This site is run by THE BONES PROJECT LTD, trading as THE BONES FUND, a company limited by guarantee registered in England and Wales, company number 17410208, registered office 128 City Road, London, EC1V 2NX.

A company limited by guarantee has no shareholders and pays no dividends. The Bones Project Ltd is not a registered charity. We will apply to the Charity Commission for registered charity status as soon as we are able to do so, and we say so plainly wherever it matters.

Donations

A donation to The Pot is a gift. It is not a purchase, you receive no goods or services in return, and it does not create a contract for anything to be supplied to you.

Donations are taken by Stripe. You choose whether to give in pounds, US dollars or euros, and the amount shown at checkout is the amount charged — we do not convert it. If your card is held in a different currency, your own bank sets the exchange rate and may add its own fee; that is between you and them. Donations we receive in dollars or euros are converted to sterling when Stripe pays them out to us, and the conversion cost is borne by the fund. Stripe emails you a receipt. That receipt is proof of payment; it is not a charity tax receipt and carries no Gift Aid declaration, because we are not a registered charity.

Refunds. Because a donation is a gift rather than a purchase, there is no general right to cancel it. If you have donated in error — the wrong amount, a duplicate payment, or a payment you did not authorise — contact donate@thebonesfund.org as soon as you can and we will look at it fairly. We will normally refund a genuine mistake where the money has not already been passed on.

Where the money goes. All profits are donated to the causes listed on this site. We do not guarantee that any individual donation goes to any particular cause, or the share each cause receives. The Bones Project Ltd acts as a non-profit, but payments are occasionally made from The Pot where necessary to run and grow the fund — domain and website hosting, email hosting, marketing, legal and accountancy costs and similar. Stripe's processing fees are deducted by Stripe and we cannot waive them.

Merchandise

Merchandise is sold and fulfilled by Fourthwall. When you check out you leave this site and your contract for the goods is formed on Fourthwall's platform, subject to their terms as well as these. Prices are set in US dollars because Fourthwall is a US company; your bank's exchange rate applies.

Our prices reflect buying a product that includes a charitable donation. Around 60–70% of the profit on each item is donated.

The music

The Bones Project Ltd owns the master rights to BONES, gifted to the company by Ross Harris. Master royalties collected by our distributor go to the fund. Streaming BONES on any service is subject to that service's own terms, not ours.

Using this site

You may read, share and link to this site freely. The BONES FUND name, the rose artwork, the wordmark, the photography and the site's text and code belong to The Bones Project Ltd or its licensors, and may not be copied for commercial use without our permission. Cause logos belong to the organisations they represent and are shown with their names for identification.

The shareable story card is made for you to post. Please do share it.

Please do not misuse the site — no attempts to break it, overload it, gain unauthorised access, or use it unlawfully.

Accuracy and availability

Figures shown on this site, including totals raised and stream counts, are updated by hand and are indicative rather than live accounts. Royalty figures are estimates and are labelled as such. We try to keep everything accurate but we do not warrant that it is complete or current at any given moment.

We do not guarantee the site will always be available or uninterrupted, and we may change or withdraw any part of it.

Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under English law. Your statutory rights as a consumer are not affected by anything here.

Beyond that, we are not liable for indirect or consequential loss arising from your use of this site.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

Changes

We may update these terms. The date at the top shows when they last changed. They will be revisited when we apply for charitable status.
